Overview
Properties that have been rehabilitated using HOME funds are subject to specific rules designed to ensure that they remain affordable to low and very low income households throughout the required effective period. Owners and their agents must plan and maintain compliance with the HOME regulatory requirements associated with the utilization of HOME funds in multifamily properties.
It is the responsibility of the Minnesota Housing Finance Agency (Minnesota Housing) to monitor the continuing compliance of units that have received HOME funds in accordance with HUD regulations contained in 24 CFR Part 92. It is also Minnesota Housing’s responsibility to ensure that property owners retain the housing units as affordable to low and very low-income persons throughout the period of affordability.

Compliance Forms
All HOME unit households must be certified for initial eligibility and recertified annually thereafter. For Minnesota Housing’s HOME properties, tenant income is calculated in a manner consistent with the determination of annual income under section 8 of the United States Housing Act of 1937 ("Section 8").
For guidance in determining tenant income, the HUD Handbook 4350.3, Occupancy Requirements of Subsidized Multifamily Housing Programs, is used and is recommended as a reference guide. The HUD Handbook 4350.3 can be found at http://www.hud.gov/offices/adm/hudclips/handbooks/hsgh/4350.3/index.cfm.

Compliance Reporting
Owners must submit tenant income certification and demographic information using Minnesota Housing's Compliance Monitoring System (CM System) for each HOME unit. Owners Must report all move-ins, re-certifications, move-outs and other activity. Data entry instructions are provided.

Forms for requesting approval to refinance non-Minnesota Housing loans; subordination; consent of easement; partial release; change of use; changes in ownership structure (name change, change in entity type of change in partnership interest); payoff/satisfaction; casualty loss/insurance claim; for service-enriched or supporting housing, change in approval of Minnesota Housing for its deferred loan programs.
